Revised Hazardous Cargo Rule & New Misdeclaration of Cargo Rule

Dear Valued Customer:

Westwood Shipping Lines is providing advance notice of change to the Hazardous Cargo rule and new Misdeclaration of Cargo rule.

Effective May 20, 2022, Tariff 032, Rule #13, Hazardous Cargo, Section C, paragraph 4B, and 4D, will be updated as below.

Summary of Updated Hazardous Cargo Rule effective 05/20/22:

4B) If shipper and their agents do not comply with all applicable regulations Westwood Shipping Lines will assess a Hazardous Non-compliance charge of $35,000 per container.

4D) Carrier has the liberty to refuse or terminate hazardous cargo where shipper and/or their agent is not in full compliance with regulations and/or other rules governing the shipment of hazardous materials. These governing bodies may include but are not limited to International Maritime Organization, Vessel Flag State, US Department of Transportation, Transport Canada, United States/Canada/Japan/Korea/China Government, etc.

Effective May 20, 2022, Tariff 032, Rule #2, Sub Rule #17, Misdeclaration of Cargo will be introduced.

Summary of New Misdeclaration of Cargo Rule effective 05/20/22:

Misdeclared charge of USD$35,000 Hazardous, USD$25,000 non-hazardous per container.

Carrier has the liberty to refuse or terminate any contract of carriage where shipper and/or their agent is not in full compliance with regulations and/or other rules governing the shipment of cargo.
